Hi Apple,
Dont lose hope and dont lose sleep over it. I know it's easy to say...but just hang in there. Everything will be ok. As someone suggested, all you will be losing is at most 10K. Even that, you can transfer to some where else and should not be paying a cent. Why go now itself? Let's suppose that the judgement is not in your favour, may be , after a couple of years. Then you can quit your job and say you are leaving. I dont think they can stop you at that time. And I dont think they can make you work either, if you decided not to take up a job. Then file banktrupcy and go back to your country. Relax for a couple of years and then come back.
So, all i would suggest is stay calm and let the trial take it's course.
If you do not want to go through all this stress then as someone suggested , try for an out of court settlement. Tell them all you have is about 2K( take off all the money before that). Then they will know what your position is and might settle for that. Better take an attorney so that this is settled for once and all.
It's possible that the target might not even be you. There might be some millionaire in one of the other cars.
That's my 2 cents.
So, just stay cool man..you are not going to lose anything.
A proverb comes to my mind:
"Try pulling a mountain with a hair. If you succeed , you will get the mountain. If you fail, all you have lost is a hair"

Looks like they are going to use the unused EB visa numbers for FB.To me, this is family reunification bill and most likely will not have any benefit for us.
I think we need to study the bill in detail before we jump to any conclusions.
From reading the summary in the AILA website, specifically the below :
The legislation would reinforce our commitment to families and reduce current wait times in the family immigration system by:
Recapturing an estimated 400,000 family-sponsored and employment-based visas that went unused between 1992 and 2007.
Atleast to me it seems like the bill plans on using all the unused visas from the past years and apply that towards the family quota. Not sure if that would help the EB cause.
Inputs anyone?

Thanks for the effort.
I posted my comments and my story (with links to couple articles that were published sometime back about my case in a newspaper).
Lets add more stories. As someone already suggested lets concentrate on how our GC can contribute to the economy - buying a house/establishing a company/etc. I also quoted some of the recent studies that showed how immigrant entrepreneurs positively contributed to the economy (couple links from IV).

Probably his employer is finding excuses not to file his GC and like his employees on H1B.
Dude, whatever it is, get out of that hole if you cant get GC filed.
1. Line up another job.
2. Go there or else, tell your employer, that "Find a way to file my GC, otherwise HASTALA VISTA baybee...".
3. Choose your option.

I see only one problem in this logic! Many cases I know of, at least from the 2007 H1B fiasco, paid for the H1Bs through consulting companies FROM THEIR POCKETS. So to answer your question as to why companies would spend $5000 in anticipation, is that they don't. They take it from the applicant. (again I am not saying all do, but there are abusive companies that do).
No cap on visa numbers will never fly... No political environment will be conducive to bringing in unlimited foreign workers without any restrictions. L1 has no caps because it is very difficult to qualify for an L1 visa, as far as I know. If caps in H1 are removed, you can bet there will be severe restrictions imposed on other aspects of the program.
That's right. I personally know people who have been asked to pay INR 250K (About $6K) to get their H1B done. So the companies have nothing to lose. They just want to have an upper hand with readily available supply of H1B workers if and when an American client is looking for a consultant.
They do this without spending a penny from their pocket and sometimes even make profit just by sponsoring H1Bs for people in India.
As a result, genuine visa seekers are denied a chance to get in and start working right away.

Chanduv23,
Can someone use AC21 even if the person has not worked in the company but 180 days has passed?
Yes,
assuming I-140 is already approved and it is past 180 calendar days after I-485 filing date.

I have seen so many in this forum spits on L1. This is really bad, we all belong to one family and one kind.
If some one thinks L1 is more advantagous why don't those people join TCS or some thing...
Well let me put some of the Disadv.
1. On L1 one canot change the job. If you want to change the employer you should have H1B
2. L1B salaries are 20% less than H1B on AVG
3. If employer want to send you back (For any silly stupid reason) you are gone
4. Most of the companies like TCS, INFOSYS, WIPRO won't file green cards for 99.99% people
5. On avg a L1 person stays in US in a trip for 1 - 2 years.
Now think!
And above all as I said all those L1 are living in this country legally like me and you, living a painful uncertain life. Because the time is bad now we can't blame them.
Some one talking about getting laid off with TCS employee. just recapture the 5 or 8 years back when you replaced a AMERICAN CITIZEN and you can't call people as idiots ... its street clear.
Well some of you may not agree with me, but if you want to respond harhly just visit any L1B guys house some how they are living.
Unite, Fight! Don't fall for same old british divide and rule tricks.

If you heard what the restrictionist lawmakers have said about what to do with illegals, this retrogression makes sense. The restrictionists want to make life miserable for illegals by making it difficult for them to get jobs, this way the illegals would go back on there own.
They are trying to do the same thing with us legals (without saying it aloud). If you are from India it will take you at least 6 to 8 years (if you are lucky) to get a green card. Frankly in the fast changing technologically advanced world how many people can hold on to the same job for 8 years straight, they cannot. People lose jobs because they are laid of, the company has run into bad times, the technology has changed and the company wants to move you to a different role or position etc, this way a lot of people have to switch jobs which invalidates thete green card process. They are making your life miserable so that you are broken down psychologically and finally will go away either on your own or because of some arcane rule, example the labor should be applied more than one year before h1 expiration etc, a living example is that Indian guy who posted recently that he is leaving US to work for Microsoft in Canada. This way they get the best of both worlds, you have young people in the prime of there life without any diseases who do not burden there medicare system, working hard and paying social security taxes and medicare taxes (which they will not get back) and in the end they are kicked out or go away on there own.
You got it right or what!!! That sounds like the modern definition of slavery and seems to be what is happening in US despite all the claims of abolishment of slavery. They just have refined it to a point where it is subtle and not so blatant.

Actually, not all he said was wrong.
We should not support what these IT consulting companies are doing with H1B programme just because we are on H1. These big companies are hoarding H1B visas so they can have an upperhand when dealing with the employees.
My own employer was trying to get as many H1s as possible without having ANY work for them. They sent us all a few emails asking us if we had any family or friends back home who want to come to US on H1. These guys make the H1 applicants pay for the application expenses, then just keep them there or get them here and keep them on bench and almost everybody here is familiar with what happens next.
Think from an American's point of view.. It is THEIR country, THEY make the laws that benefit their society and economy.. they have all the right to stand up against these practices by foreign based companies..
I like his statement "H1B is supposed to be used when there IS a job but no American to do it" What these Consulting companies have turned it into is "There is a person on H1B avaliable If and when there is a job to do" OR worse "There is an H1B holder available, on bench, but no job to do"
I totally support reform in the H1 process with a target to reduce fraud. That will ultimately benefit people like us who will come here on H1B in future.
Please don't fire me for taking his side, I'm not. I'm in favour of market deciding what it needs, but I'm 100% against fraud, and all of know these so called consulting companies ARE indulging in fraud..
Cannot agree more on the fraud prevention . Increasing the H1B application fees is not way of preventing fraud .This is punishing the small innovative companies from catching up and importing much needed talent .Keep the same fees , catch the fraudsters and make an example of them to others .

Looking at discussion going on here, its sure that IV have financial problems & only 5% (of total 8000 members) are contributing for the cause. Now, if we restrict IV website for "paid" visits, dont you think that IV membership is reduced by 95% to only 400 paying members?
Instead of making "Paid" web site, I think Moderators needs to delete derogatory posts & block such userids.

Can I add my spouse before or After marriage?I am planning to get married in 4 to 5 months. My attorney told me that he will be ready to file I-485 in July and my current H1-B is valid till Dec 2007,so if I go back to country for marriage and coming back on AP,so I think so I will be ok,but should my wife able to get H-4 visa stamp on her passport and once she came back in USA on H-4 should I will be able to add her right away in I-485 when PD dates will be current or should I have to wait 60 days then apply her for I-485.

Yes she needs to be here to file I-485 and then she can leave and stay there..
Thanks for the reply, I am assuming she has the same requirements as me in terms of medical , right which means another 2 weeks after she arrives. If she can't make it here in July, can I file under CP for her. Would she then get her EAD at the same time as me. I have been trying to get in touch with my lawyer but he's not there, and I want to make sure I add her in before the dates get retrogressed again.

Though it is not related to this thread, it is a decision that only u can make. A friend of mine whose priority date is nowhere close and is still on h1b used his AP to reenter the US and when I asked him why he did not want visa stamping - he said "who will go through all the hasstles of appointments, stanidng in queue, wasting precious vacation time when you have a AP to reenter" . Now thats him - but u can make ur own decision based on ur corcumstance.
