I filed for 485 during July 2007. My 140 was already approved. Due to some problems I quit my employer in August 2007. My previous employer was a desi blood sucker. I was fed up & decided to quit after working for him for 3 years. I applied for H1 transfer with a new employer based on approved 140. I got H1 approval for another 3 years. Currently I am working for the new H1 sponsoring employer. I also received an EAD card based on pending 485 for one year. I didnt notify USICS of job change in July.
I applied for EAD extension this year. The application for EAD extension is pending. I got a following RFE on my 485:
Please state whether or not you are currently working for your I-140 petitioner.

Lose A LOT of money if you get laid off and forced to leave the U.S. - If you have a 401 K and the broken immigration system forces you to leave the U.S. in the self-induced U.S. Reverse Brain Drain, you have to leave all your savings behind and use them until you retire in your home country (yet cannot contribute anymore and thus money stops compounding) or take the money to your home country after taking a huge hit from early withdrawal penalties.

All their "research" is suspect, this is just the most obvious. I did start building spreadsheets to regress employment/unemployment numbers with each immigration law they cite. There was no significant correlation. I should really do that again and post it somewhere.... Gotta get some better regression software though. Work like this will point out that the king has no clothes.

Need a suggestion on finding a job!
My friend has a master degree in India and worked in India for 6 months in Seimens before coming to US. Now she has EAD and would like to start working. Its been 3 years she left India and been idle.
She would like to start as a fresher / jr in IT though she has little experience.
When I asked a couple of guys, they suggested to approach Desi consulting companies.
From what I heard, they train and put up some fake exp and then apply for jobs (and of course need to sign a contract). But she doesn't like that.
I know a lot of people are in this situ too. I believe some of you have been here for a long time and have dealt with desi and US consulting companies. Some of you guys have good insight into these matters as well.
So what do you guys suggest?

WAKE UP CALL FOR THOSE STILL SITTING ON THE SIDELINES
On Tuesday, when we were on the Hill doing meetings during Advocacy days, we were informed by the senior Senate office that an amendment to prevent H1 and work authorizations is in the works in the Tax bill. We immediately requested this office to oppose this amendment. Senator office expressed full support for us and shared with us that the Senator's office has already expressed opposition to such an amendment.
We would like everyone to know that just because someone has EAD, it does not mean we are in safe haven. There is no safe haven till we have approved green cards. And for those who think that they don't need to participate actively, this is a wake up call.
We have also learned that this is degree 1 amendment. This means it will be voted on on the Senate floor even when it is non-germane to the bill. We have also learned that if such an amendment comes up for vote during this difficult political climate, it appears that such an amendment will have 70 votes in the senate which makes each one of us extremely vulnerable to be forced out. Everyone on H1, L1, J1 or EAD will risk the renewal of their current application status.
IV is working on defeating this amendment. Please stay tuned for further updates.

If for a moment we say USCIS has really increased the processing rate and more people are getting green cards which we see is the case. It may signal that on Oct 1st,2007 dates will move ahead of what was the scenario in May visa bulletin.
If we forget the mistake they did in July bulletin and see the brighter side that they process faster, we should hold back our applications now and wait for the scenario on Oct 1st 2007, which would be hopefully a give a good realistic forward movement in dates. Since receipt date is important we should not get emotional and send in the application. This is just a thought.
Making Current in July was anyway like a lottery which denied all calculations based on pending cases.Before getting into law suits and protests which are also needed we have to take stock of all the implications and whether we really can provide 100% to these efforts.
From the posts coming since yesterday, most of the members are agitated and it seems we fail to realize that this event itself was a miscalculation and all of us were trying to get benefit of it considering the long waits we have endured for just getting a chance to file AOS.
We also knew that even if the applications are accepted there was no way we can get our green cards for a long time. AC21 and EAD for spouse was the main aim of many applicants.
This is really a sad story of people who have sacrificed career prospects, faced family separation, made important decisions like marraige.
Hope this post makes sense and we take a step back and reconsider our actions. This is not out of fear but past experience of lawsuits explained in other posts.
Lets contribute... We have big day ahead of us..

I am current now (PD: Feb 16th,06) and last time when i was current in 2008 for a month i got an RFE. Even though the attorney replied to the RFE in 3 days, all my case status shows is RFE response received.
Ours is a big company and close 2000 people applied for 485 during the July 2007 fiasco and we were asked to send the G28 forms to the attorney by mail with no signature reqd. Apparently almost every got an RFE for that.
I wish i could get to know if RFE was all taken care of and my case is pending for a VISA number. Any way to know if thats the case gurus?
My case is exactly same as yours except my PD is Feb 27th and I received an RFE for Birth Certificate when the dates went current in 2008 August. Since then I saw LUD's for 3 weeks and then its been all quiet I am hoping that means application was pre adjudicated.

I clearly mentioned each of the following country and category. To make sure, I also mentioned that we do not need combined total of pending AOS applications. If the request is ambiguous or means different things to different people,please let us know and we can make needed modifications asap. Are you recommending to hand out a blank tabular format .to USCIS FOIA?

So we should probably bullet point the data we need at least and if people don't think there is any harm in putting in a table for the format of data needed that will make things very clear. I agree with you that breakdown of quarter/month is probably not needed and might actually hurt our chances of getting the answer within reasonable amount of time.

Is it legal to make photocopies of your passport in the US? They dont do it in FEDEX Kinkos etc., Ofcourse you can print it in your house.

OP, just so you know, the majority of the posters here have to endure long long waits for their US green cards, greater than 10 years sometimes. Because of that they tend to become hyper sensitive when it comes to immigration matters, especially when they think someone is stepping out of line and trying to manipulate the system. Dont mean to imply at all , thats what you are doing.
Your case is too complicated and I haven't come across such a scenario; I'd suggest talking to an attorney; while it might be expensive, some attorneys might be willing to talk to you free for a few minutes, for a basic consultation. Atleast you may find out if you are legal or not.

I admit, it seems discriminatory to say you can't get your GC now because you're from this country or that country but these "high volume" countries have created the current back log through their sheer numbers and sometimes multiple applications, not the system. The system is fair to ALL and for some group to say that it isn't fair because all of that group isn't getting what they want is unjust to the rest of us. I knew I would be pounced upon when I submitted my original post and it only proves my point of personal agendas; sometimes I wonder what the "I" in "IV" really stands for? Don't be so arrogant as to believe that your higher education should give you more rights than others - that doesn't fly with me! I am frustrated with this forum because of this arrogance and I may not visit too much longer!
I do have one question for all of you who are in favor of eliminating the per country limit; do you support an eventual road to citizenship for the large group of people who dominate the "other side" of immigration? If you don't, some may think you hipocritical to want the rules changed for yourselves!
Sheer number of applications from the high volume countries has created the backlog?? Are you saying/wishing that these people should not have come in the first place to avoid the backlog?? My friend, backlogs did not happen completely because of the sheer number of applications and gaming. Backlogs happened primarily because of wasted visa numbers and issues surrounding it. If there was no visa number wastage the priority dates would have been around 2-3 years behind as opposed to 7 or 8 years. There are gamers in every system. If a system does not work for people as it is supposed to, gamers do so to get out of the system. Not that IV condones such things but it happens in any system, when the system is broken.
The I in IV definitely does not stand for me only or for any one only. I along with V only makes sense. I by itself does not get IV any where.
So removing the per country limit would remove the "bias" off these countries and move it to the ones with lower populations; so, in essence the discrimination would be reversed?
On one hand you are saying that there is a bias towards lower population countries now and you are ok with it, just because you happen to benefit from it. Is that what you mean?
If retrogressed countries are asking for 75% of the numbers reserved to them rather than having one line for all, You have a good point in saying that the bias is shifting towards retrogressed countries. There is no such provision like that. The provision creates one line depending on when you entered the line. You enter the line ahead, you get it first.
So keeping the limits intact is NOT a bias to you? You can't have it both ways. What do you think is a solution? The point system you referred to came with the same 10% limit on the retrogressed countries. What difference does it make to a retrogressed person with 96 out of 100 points, but still needs to wait for 4 years, while some one from Krakozhia walks away in 6 months with 60 points. B T W , you also said that higher education deserves more does not fly with you. I am not sure how you want points to be assigned, other than education and experience. Don't let the fear and protectionist thought take over the logical and rational thought.
The "other side" of immigration is an entirely different topic. Their issues and our issues, their path to the end line and ours are entirely different. We can't simply compare apples and oranges and call people hypocrites. That said, I personally support it and feel that it will happen at some point depending on the majority in both houses and one party will suffer for the decisions it made. Sheer number of applications from the high volume countries has created the backlog?? Are you saying/wishing that these people should not have come in the first place to avoid the backlog?? My friend, backlogs did not happen completely because of the sheer number of applications and gaming. Backlogs happened primarily because of wasted visa numbers and issues surrounding it. If there was no visa number wastage the priority dates would have been around 2-3 years behind as opposed to 7 or 8 years. There are gamers in every system. If a system does not work for people as it is supposed to, gamers do so to get out of the system. Not that IV condones such things but it happens in any system, when the system is broken.
The I in IV definitely does not stand for me only or for any one only. I along with V only makes sense. I by itself does not get IV any where.
So removing the per country limit would remove the "bias" off these countries and move it to the ones with lower populations; so, in essence the discrimination would be reversed?

If retrogressed countries are asking for 75% of the numbers reserved to them rather than having one line for all, You have a good point in saying that the bias is shifting towards retrogressed countries. There is no such provision like that. The provision creates one line depending on when you entered the line. You enter the line ahead, you get it first.
So keeping the limits intact is NOT a bias to you? You can't have it both ways. What do you think is a solution? The point system you referred to came with the same 10% limit on the retrogressed countries. What difference does it make to a retrogressed person with 96 out of 100 points, but still needs to wait for 4 years, while some one from Krakozhia walks away in 6 months with 60 points. B T W , you also said that higher education deserves more does not fly with you. I am not sure how you want points to be assigned, other than education and experience. Don't let the fear and protectionist thought take over the logical and rational thought.
The "other side" of immigration is an entirely different topic. Their issues and our issues, their path to the end line and ours are entirely different. We can't simply compare apples and oranges and call people hypocrites. That said, I personally support it and feel that it will happen at some point depending on the majority in both houses and one party will suffer for the decisions it made. As a by stander, I sympathize with the situation the "other side" has been in. I have a full plate to work on.

Pardon my ignorance and pls help me understand, how does PD impact the mass 485 applications sent July/August 2007?
I thought the PD is only relevant for being able to apply for 485 and didnt matter if your 485 application had been received. Am I wrong?

Why not july 2006??
Well, atleast RIR/Pre PERM Backlog Applications can be processed. BPCs only closed in DEC 2007. So, some of them missed the Aug 07 deadline. I'm NOT against 2006 or 2007 applicants!
