Lou is talking about H1 badly. Does he know how schools are facing problems without H1. Thousands of schools have no math and science teachers in rural areas. Why cant he make the americans to work in that area. Most of the schools are using teachers over 75 to 80 years old. Most of them didnt know how to use computers. Then how they teach good to students. Principals are struggling to run the schools with out teachers. Parents are disappointed without proper teachers. With this level, how can America make best future.My kids are struggling without proper teachers. When we ask the schools, they are saying they couldnt get proper teachers. If Lou's grand kids face this trouble, then he wont talk. With this situation, how schools can make AYP(adequate Yearly Progress) according to No Child Left Behind Law. First the Govenment must take necessary steps to solve this issue

I am settng up tea stall at Asian Festival(just for fun) , i will give all my profit to IV. Approx. 20,000 people visit the festival so i should be able to make atleast $200-300 profit with my tea stall.

The intent of US immigration (employment or otherwise) is to import diverse population such that it benefits US in various different ways (socially, culturally, economically). Employment category comes under the larger umbrella of such goals.

Diversity is definitely not meant for EB based categories. EB immigration is purely based on merits. I think you are inventing a new "intent" here.
I remember one republican member of judiciary committee recommending to get rid of Diversity visa category all together and granting those visas to EB category while discussing the visa recapture bill.
He also proposed to reduce FB immigration and grant those visas to EB.
Why are you sounding like an anti-immigrant ? Did you already get your green card ?
Anyways bills and amendments are meant to fix laws that are outdated or irrelevant.
If US was really concerned about diversity, they should take into account the ethnicity of all GC holders and citizens when considering the country limits.

@krishmunn thanks for your analysis too , i had sent him a bunch of emails about 10 of them and he never responded to them, when i called him about why is he not replying to my emails he said i cannot have any email conversation with you, it did not strike me then why ? but after talking to all the guys here i understand why he said so, i do not know if this would be enough . but i am just preparing my packet to send to DOL

Well i really appreciate your concern and i wish that you were a part of my employers team, but i have my tickets booked and bags packed . Again, I would like to reiterate that I DO NOT consider an EB-3 candidate inferior just because he/she belongs to a catergory with a lower priority.
But, if you agreed to file in that category then you probably made a compromise and it is not wrong. Everyone is a victim of circumstances at one point or the other in their lives.

It is not an easy or trivial task to "just move on" and pursue plan B or plan C.
True. If the plan B/C is not up to par with plan A then it is definitely hard to move on. Plan A (GC) gives you a grand standard of living but Plan B (India etc.) gives you a first class citizenship plus a say in the society. It's not all bad.
With passage of time, the priorities and the drive of people change.
Given the passage of time priorities/drive should be geared more towards securing and making the best of what you have (home country's citizenship) rather than what you don't have (GC). Heck, even retirement based mutual funds work in that fashion (aggressive at first, conservative as time passes).
So, the immigration system should be quick and transparent.
No offense but it comes out a bit narcissist like ... don't ya think?

This is how I used my EAD. I filed 485/EAD/AP in July 2007. I did not do anything till Feb-2008. I made a call to my employer in Feb-2008 (6 months after I-485) and asked him to give me a raise. He was aware of the fact that I can use AC-21 and leave anytime. We renegotiated everything, this time heavily in my favor (for a change). I got 20% salary hike effective from that very day. I kept same employer, same job, same client but used EAD and AC-21 to put pressure on my employer. Needless to say, in the past, I have been on the receiving side of the pressure from employers because of H1-B too.

Right, but employment and family are further broken into sub categories. Which group is FX (F1, F2,etc) and which one is EX(EB-1,EB-2,etc)? I see these two categories that are generally not in the visa bulletin I see on the state gov's web site:

Since you can study under H4 you cannot apply for F1 (My wife tried that already) :)
What if the spouse (H1B holder) has to leave the country for some reason, say for an year? Then how is the student supposed to maintain his/her status?
So, I don't think that is true. If you get admission as a full time student, then you should be eligible for F1. My husband did this successfully in 2001.

Lets move on and focus on this main topic...
Here are my observations.. Correct me if I am wrong..
1. L1 option for IT is essentially killed
2. Small IT companies will limit the headcount to 50 per company. It doesn't cost much to have more than one company. So no major changes to H1B Desi companies.
3. Most of the big American companies will not offer new H1B with 180 days, since most of them would have had layoffs.
4. Most IT companies will start spending a lot on lawyers. So they will be rich. There will be lot of audits.
5. Companies will complete PERM and I140 before getting a guy onsite, only if people are really interested in coming to USA any longer.
6. Need more clarity on where H1B outsourcing will be stopped...

it may look like it that it has made our situation worse. But it was never good to start with. The visa number flow was going to EB3-ROW. Now it is going to EB2-I. That is good since if EB2-I becomes current the flow would come to EB3-I as we have older PD people than EB3-ROW.
Nevertheless, EB3-I was always the last link in the chain and still is. Nothing has worsened or bettered. If anything can be good for us, it is the 5882 bill. Another thing that can help is removal of country quota. With so many EB2 people getting their GC, we are going to need to really work towards getting contributions for lobbying since the people who get the GC cannot be expected to help IV anymore. We always were at the bottom and are still at the bottom. We need to unite and work with IV so that we call can get what we want.

I just looked at my old cases(H1Bs-I-129) and i see LUDs on them too!!! This is so weird.
These are from my last company!
LUD on 05/06/2006 - Approved on October 11, 2003
LUD on 10/21/2007 - Approved on March 19, 2002
I see LUDs but no difference in the status. They both say approval notice sent.
whats your PD and 485-RD? Maybe your case is close to approval and they are just looking up older H1s

But as I have noticed, there is a lot of misinformation being spread around H1-B holders. One of those is that H1-B holders don't pay taxes. I have now read it at so many places, if I didn't know anything about H1-B visas, I would probably have believed it by now. So we really should make a point to mention that we pay taxes and social security.

Perhaps, we need to tell the press this, although I haven't seen an article in a respected newspaper that makes such a claim (I could be wrong, and there may be such reports). My point was that we cannot use that as a reason to get immigration benefits. We are supposed to pay taxes because that is the law. These taxes are needed to run the country that we are living in.

I am not sure under what BILL they have a provision to remove US degree holders from actual Visa Numbers...but, we should also keep fighting for that because this would have two fold benefits:
1. All US degree holders will be benefited.
2. These US degree holder Numbers can be used by Non-US degree holders.
As everyone knows, most of the students will be unmarried when they enter the country for there degrees...and apply for GC after getting married....so, definitely if these numbers get eliminated from the actual visa numbers we would have double the numbers available for non-us degree holders...what do you guys think..????????

How can people write this kind of information. Even I have come through and Indian company and I used to pay all taxes here which includes, Federal, Social, State etc.,
This should end. People here should know that we are paying all taxes. And we are paying Social Security tax as well. Because of retrogression we don't yet know if we would get our green card. We still pay for it and we don't take a dime of it if we have to go back to India.
We are helping the elders to have regular pay and this is what we hear? If there is a way as our friend said we should confront this legally.
