H1B problems have nothing to do with retrogression.
If H1B employees are being mistreated by a certain class of employers, then what does that have to do with shortage of visa numbers?
Nothing.
Misuse and abuse of H1B program did not cause retrogression. And if the abuse ends, its not going to end retrogression. The H1B program does provide ammunition to anti-immigrants to use that paint-brush and paint the entire program of H1B and Employment based GC as bad. Fortune 500 companies dont engage in unethical behavior. The TCS, Wipro etc maybe do that. Small bodyshops certainly do that. I am yet to see a small body-shop, operated by a citizen of foriegn origin, working by the book and treating employees well.
But all said and done, these things make our life more difficult and exacerbate the situation that arose from retrogression. However, these things didnt cause retrogression.
At the most, these issues of H1B abuse may have provided support to some groups in keeping the H1B quota down. However, it has nothing to do with EB quota. In fact, IEEE-USA advocates bringing down H1B quota and RAISING the employment based GC quota, in order to remove factors that encourage employer abuse.

IV moderators and members must not encourage things like "ABC company not paying bench salary for my wife though he took 3k from me to file for h1 and is holding her paystubs etc"" These are the things that will make it difficult to fix retrogression - in these kind of situations it is both employer and employee at fault.

Thanks for your efforts and initiative. Those who or not part of Core team has no right to question thier ability, or asking for updates every hour. This is purely a volunteer organisation founded and managed by Core team.
PAPPU and logicfile have every valid point. How many of us are really trying to help either work or financially? However we visit the site 10 times a day.
Well I request the CORE to kindly ignore and try to achieve our goals. No doubt in this aspect you are the leaders who took initiative. we try to follow and support our best.

Banking service is still way behind in comparison to US institutions. ICICI has to compete with nationalized banks in terms of competency and customer service so they surely do better but it is highly openly discriminatory depending on how valuable they think you are to them. Something that exists here but is very transparent. But I am sure ICICI has engaged in many questionable practices from marketing to collection, there have been some lawsuits as well against them.

We have to understand that there is a myriad of laws; INA, CFR's; USCIS policy binding memos; internal memos; appeals decisions, court cases, precedent aao decisions, precedent legal cases.
Now; the ac21 memo is a memo that uscis officers have to follow. However; the memo is not in accordanc with INA 245 or AC21.
INA 245 states that a valid and approved 140 is needed for a person to get lawful permanent residency.
ac21 says that a person can change jobs after 485 has been pending for more then 180 days.
The above two things are the law.
In ac21 law; it doesn't say anything about the scenario if 140 is revoked by employer. It is totally silent to it.
USCIS in their memos realized that ac21 law would not have any meaning if the employer still controlled the 140 if a person was eligible for ac21; therefore, they issued the memo (memo is not law but binding; memos can be changed; however, there has been nothing public about any possible change).

Don't fight for Eb2 vs Eb3 or Eb2 vs Eb1 etc. If we focus on these 3 bills then it will solve all our problems.
(1) STEM bill remove all MS + Phd people so Eb2 will be half empty and Eb1 will be 80 % empty.
(2) Re capture will bring new visas where they will go certaily to Eb3. ( Eb1 and Eb2 do not need visa if passes STEM bill )

Contrary to what most believe - Contributing is the easiest thing to do. Send some money and forget about it. And the most effective one too. Lobbying is IVs greatest tool to make changes in the legal system. If you still don't get it, you cannot get any law passed in Washington without lobbying. Whatever we do on the side is to help that effort.
Volunteering is much more tougher. By volunteering I don't mean giving the next Brightest Unworkable idea or the daily-dose of rants on an online forum. Volunteering in my world (real one) means sacrificing personal time (with family) for the greater good of a community.
Calling members, planning & conducting meetings, telecons, write letters to lawmakers and meet them, put IV booths in local events. In short, it's a thankless job. At the end of the day you're more hated than loved (ask Chandu)!
IMO Volunteering and contribution are not separate. It's member buy-in. Either you agree to a principle or you don't. If you agree, you'll contribute as well as volunteer (when you can). If you don't agree, you don't.

I called my attorney after seeing this thread. This is what I heard from him.
We have not received it back from CIS. We have not received any of them back that we filed. CIS said it will unequivocally reject them. But as of Monday they have decided not to send some back (many were already sent back) pending some internal decision-making about how to handle them. We would let you know if anything happened.
lawyer says "many were already sent back " did any body who filed on 2nd July got there application back ??
