I am not sure under what BILL they have a provision to remove US degree holders from actual Visa Numbers...but, we should also keep fighting for that because this would have two fold benefits:

    1. All US degree holders will be benefited.
    2. These US degree holder Numbers can be used by Non-US degree holders.

As everyone knows, most of the students will be unmarried when they enter the country for there degrees...and apply for GC after getting married....so, definitely if these numbers get eliminated from the actual visa numbers we would have double the numbers available for non-us degree holders...what do you guys think..????????

Hi Guys. I am trying to take an appointment in Jan. The earliest I can get is 11th in Kollkata. I have booking to travel to US on 26th. After listening to the delays here, I am confused where to go for stamping or return with AP.:confused:

Please advise; guys who have been through stamping recently. Appreciate your feedback.

About couple of weeks ago my employer had arranged a, life after AOS with our attorney and in their presentation they clearly mentioned that if you have AP don't go for visa stamping waste cople of days of your life.

Correct me if my attorney is wrong and if there is any advantage in getting the visa stamped.

Dude, I'm not flaming at you (it was gctest not you) but you also made really demeaning statements and then tried to retract them when you started getting reds, I think. Its not good to trash others.

Which statements of mine are demeaning?
I edited 2 posts because of grammatical errors.

People finishing residencies and fellowships on j1 visa go through some unscroplous lawyers and agencies and manage to get a waiver job by spending at least 20 to 25K.

What I want to say is, entire system is like this. Just not consulting companies

EB3 I is still very unfortunate... I guess this is how the melting pot works... correct me if I am wrong.

Out of 140K Visas 7%= 9800 is assigned to India (All Categories)

Out of 9800 - First EB1 then left over EB2 and Then leftover to EB3 :(

From over all left over of 140K - First EB1 then left over EB2 and Then leftover to EB3 (all other countries) - Left over (EB3 China) - Left over to (EB3 India) :(

EB3 India is lowest on the FOOD Chain!!!

EB3 India is not unlucky but thats the default category for any one to apply when they or job doesn't let them go for Eb1/2.

    So the obvious reason is:
when we have brand new lot of 85K H1s most of them apply for Eb3, and big chuck is Indian (no 7% cap here), but regardless of category, if 85k applies for GC, with one dependent it counts 130k.
And for GC allocation we have country cap which is ONLY 7% when we have 70% applicants. Do the math, 85000*.7*2= 119000 applicants for GC from India each year and they are entitled for 140000*.07=9800 and now lets say with all favors from ROW and EB1 we got double say about 20,000 still there is a back log of about 100K each year.

Thats assuming everybody applies for GC out of 85K H1 stock.
Based on this I don't see EB3 to become FIFO or backlogless because the system is not balanced,

    # of ppl coming on H1 each year * xfactor = #of GC given to EB each year

Can you please give a back ground of yours before talking about others ? Are you CEO of some company ?
Is that a mandatory criterion to express an opinion? If so, then you should have obliged to it first. Simple. :)

Since you can study under H4 you cannot apply for F1 (My wife tried that already) :)

What if the spouse (H1B holder) has to leave the country for some reason, say for an year? Then how is the student supposed to maintain his/her status?

So, I don't think that is true. If you get admission as a full time student, then you should be eligible for F1. My husband did this successfully in 2001.

What are you smoking dude? You 100 people go back, 1000s more are in line to replace them. Get real..!!

Let us all have a rally to move back to our countries on 4July2008 to symbolically show that we want our Freedom and Independence and never return back.
If all the articles about reverse brain drain we are reading about is true they would do something to solve this GC situation. Otherwise the anti-immigrants will come to see us off while we depart this country and never to return back as H1B's trying to get GC's and live here. This will go into history, 30yrs from now and our grandchildren will read about it. And may be we will get some special pension at our home countries for returning back and helping it to do better.

Please take the poll to indicate if you would participate in this QUIT AMERICA MOVEMENT FOR OUR FREEDOM AND INDEPENDENCE

Agreed getting a GC is a painful process not to mention the bureaucracies that go with it.Agreed serious lobbying is necessary to bring about a change in the legislative system coz waiting for years to get ones GC is plain ridiculous. But the idea of REVERSE BRAIN DRAIN is just a myth.I am pretty sure that atleast 80% of the people are just average Joes whose intellect is just better than those blonde babes of the "Girl next door" reality series. We should be glad that we were raised in a foreign country lest would have replaced those poor old folks saying "welcome to wal-mart".So lets stop talking about reverse brain drain and atleast not try to replace those intelligent ones back home. We being here is best for our country and our economy.

    Green.Tech,

I understand where you are coming from. And I am sorry that some of my recent posts were irresponsible.

Frankly, after mumbai attack I have been a different person. I come to this forum to learn and provide any information I can provide. But it bothers me to see few jerks like mirage who don't have any clue of how things work, and they just start posting on the forum "remove country limits, remove country limits, remove country limits, remove country limits, remove country limits, remove country limits, remove country limits" 30 times a day, as if that will be sufficient to remove country limits. And in more ways this uneducated style bothers me. I will try to ignore it and go my way.

I am right now going to speed dial that other side of me, good and informative side.

    .

    Sanju,

I am not condoning what 'mirage' said to you or any such irresponsible behavior on the forum BUT your complaints to the moderators would have carried more weight if you were behaving in a modest and civil way yourself. Of late, you leave no stone unturned to write flaming messages to piss off others on this forum. All this is super surprising to me because I remember you used to write really good and informative posts. It's like you suddenly lost it or that the other sanju was someone else!

Let's not all fight among ourselves. We have so many other better things to do!

Regarding the 1st point, we, or at least I, am already trying to recruit as many people as I can, also posted IV posters in a few places.
Does anyone know how the illegals got word out about their rally across the country, or specifically press coverage about it? If so, we can try to use the same source, not for a rally, but to get IV's name out and talk about our major issues reduced to 2-3 points, so it is not confusing for the public.

Regarding, 2nd point, I think we can all contribute small amounts, say $50-100, but unfortunately most of us are stuck in low paying jobs. If we can get employers involved, that could be a better source of funds. Seriously, I dont expect many employers to contribute, but maybe academic employers who are losing funding because their H1-b employees are not authorized to get it, might be more willing to contribute.

Also, is anyone aware of any Indian American politicans, perhaps local Congressmen, that we can contact? I think I read recently of one in Texas.

Here is a story on a senator from Delaware who seems to be suportive of Indian Americans, although the story is on how he made a blunder talking about them:

    http://www.cbsnews.com/stories/2006/07/07/politics/main1785303.shtml

Also, though you are probably aware of these organizations, maybe we can apporach them to help publicize our cause where it matters:
    1) Indian American Republican Council:
    http://www.iarcnational.org/
    2) Indian American Center for Political Awareness
    http://www.iacfpa.org/
I agree with rheoretro, the first thing that any member feeling helpless here should do is to get more publicity for IV. Talk to people in the same situation
who are suffering because of backlog or cannot file because of retrogression.
Please urge all your friends, influence them to contribute to IV.
Lets continue doing that on a daily basis and then if you feel you can do more, start writing to your local representatives, senators, house members.
I have written atleast 2-3 times to my senator on numerous occasions.
I feel, your words, combined with your thoughts about how this affects you helps a lot in conveying and putting the message across.

I just got sending a email message to my senator here, I am going to follow it up with a letter.
    Email message reads like this:

    Dear Senator Boxer
I have been a legal resident in state of " " for close to 5+/X years and I have been a legal resident in the USA for a total of X years.
I am a legal immigrant, whose application for permanent residency has been pending for the last 3 years.

The U.S. government makes only a certain number of immigrant visas (green cards) available each year and these are allocated among the various immigrant visa categories and countries from which applicants seek to emigrate.

Retrogression: For the past few years, the number of immigrants approved for employment-based immigrant visas has been lower than the number of visas available, resulting in no backlog in visa numbers. Recently, the DOS has seen far more immigrants approved for employment-based immigrant visas and has run out of visa numbers in certain categories, causing a temporary backlog or "retrogression" of visa numbers.

EB-3: This visa category includes employment-based immigrant visas for:

    1) professionals with a bachelor's degree
    2) skilled workers in positions requiring two or more years of experience or training
    3) unskilled workers

Chargeability: Immigrant visa numbers are further apportioned among the various countries from which applicants seek to emigrate. Each country has a limit and each approved applicant is "charged" against his or her country's limit.

Also to complicate the matters, there are those folks that came here illegally that were allowed to change status based on 245(i). Every year in Oct (start of new fiscal year for the govt) 140,000 visas are made avaible for EB3s. These 140,000 visas are divided amongst the different nationalities. Some visas are now going to be eaten up by the surge of 245(i)s from 2001. Irrespective of the the nationality of the 245(i) applicants, they are impacting every category witihn EB3. That is the main reason that almost all EB3 categories have retrogressed and will remain so for a while. Its a grim picture but thats the reality.

We need some intervention from Congress, otherwise people like me will have to wait for years - possibly half a decade or more

I support your opinion that there cannot be any amnesty for illegal immigrants, but there should be emergency relief for legal immigrants stuck in the logjam for years. We ought to make it a little fair for legal, honest and law-abiding legal immigrants.

Please support any bill that gives a temporary relief to legal immigrants (especially Employment based applicants). A temporary increase in the number of Visas allocated to the Employment based categories can substantially alievate some hardship.

    Thanks for your understanding
Future Citizen, proud resident of state of California

    Thanks
