    Thanks ilikekilo, I'll check out IMG. Even with the rider for pre-existing condition, the coverage is limited to $15000 max, so I decided it isn't worth paying the extra premium for such little coverage.

    Not all professions can apply for H1Bs. You need to have specific skills that the US does NOT have. Someone on here had once posted that his wife could not work as a teacher although the school was ready to offer her a job, coz there is no H1B category for teachers. The H1B visa cannot help spouses in all professions. Hence my suggestion.

    About how this will solve retrogression, IT WONT. My point is instead of trying to bring this retrogression beast down, maybe we should look at alternatives to work around it.

    If it is not the skill that US does not have then what argument are we going to give to lawmakers for asking for such a provision ?

    You need to restart ur GC process but you can keep ur PD (if not revoked) and get a 3 year extension immediately based on the Approved I-140.
    what if it is revoked, do we any options for getting PD back ?

    One more point:

    Know when your GC and passport expires so that you can renew it. :)

    Getting a GC does not mean you can ignore all your immigration issues.

    This is how I used my EAD. I filed 485/EAD/AP in July 2007. I did not do anything till Feb-2008. I made a call to my employer in Feb-2008 (6 months after I-485) and asked him to give me a raise. He was aware of the fact that I can use AC-21 and leave anytime. We renegotiated everything, this time heavily in my favor (for a change). I got 20% salary hike effective from that very day. I kept same employer, same job, same client but used EAD and AC-21 to put pressure on my employer. Needless to say, in the past, I have been on the receiving side of the pressure from employers because of H1-B too.

    My suggestion - You can not play safe your whole life.



    After an extensive research on internet about all this I will expose my case to hear your opinion.

    I'm on my EAD second renewal now, Have approved I-140 and my PD is Dec 16/2006. Si according to waht you say I can walk away changing emplyers and get another job or either a part time job???

    My current attorney wont give me any advices because she says is against the law because she represents my employer and me so she recomends to look for another attorney.

    Since I have an EAD my wife was able to work and things turned better but this year with the economic situation and a baby I'm about 5k short and I'm being very careful and looking for a wild card just in case.. Someone told me I can get another H1B and start over even If I have passed the 6 years of H1B.

    Any thoughts?

    We should definately ask these kind of questions. The credit is not mine completely. Another IV member asked this question at a previous debate and educated me about submitting questions to the california debate. This question did not get picked up at the previous debate. Let's work to get the question picked up this time


    I guess we should use chances like these to get our agenda heard by the people and the govt. There are going to be atleast 3 more presidential debates we should try to get this question asked atleast in a couple of them. We can modify the question to make it more broad, but still keep the focus on legal immigration problems by highlighting it.

    Let's just compare it with membership-based organizations like IEEE, for instance.

    You enroll/become a member, you get access to member-only areas of the web site, and plenty of other benefits to make membership worthwhile.

    Earlier today I received a mailer from "The Club" (Commonwealth Club of California, iirc). For the benefits offered, and for the general spirit and intent of the club, I thought the $85/110 membership dues were quite reasonable.

    My question comes back to IV - why can't 10,000 or all 25,000 of IV's members decide what we're doing is worth it, the access to information is worth it, the free legal guidance and advice is worth it, and other benefits (that may be thought up... for instance travel discounts, etc.) are worth it - to "contribute" to IV (call it whatever you will - contribution/membership dues)?

    Next, of course, is the concept of "premium" membership for web sites like WSJ.com, or technical ones like Experts-Exchange for instance. You join, you get premium content. IV has much more to offer than just premium content here.

    (As a sidenote, one example is members getting newsletters - online or paper - with expert legal opinions and answers on our most common questions. Authoritative, as much as they can be, with documentation where required... rather than spending 2 hours searching the forums and still coming up blank or inconclusive... )

    There are other logistics issues that can be resolved, and *we* = all members, will empower IV to do a lot more by doing that, imho. I can think of 20 things we can do in addition to this lobbying effort - and we won't have to start a funding drive each time we decide to do something.

    Thanks for participating in this debate and making your opinions known. Most importantly, this is about brainstorming and coming up with more ideas - regardless of whether we take this membership-only approach or not.

    Ultimately, whatever IV is able to accomplish will benefit the entire legal immigrant community, regardless of contributions/memberships. However, the need of the hour is to realize the opportunities we are missing because of lack of resources and hands in most cases.

    I guess you are talking about premium membership like wsj etc. I am not sure a free exchange of ideas can occur if we put our membership for sale by restricting access to some parts of the website. IV will lose some of its sheen and I am not sure the tradeoff in membership $ is worth it- dunno just doesn't feel right in the gut

    Has any of you guys heard of "Follow to Join". I believe that if you are "legaly married" before filing I-485 then you should be able to bring your spouse in whenever your GC is approved. If your GC is not approved by the time you get married i think she should be able to come in under H4.

    I'm in a similar situation but more complex. My fiancee was in the US on J-1 visa and had to go back because of 2 year Home residency requirement. I have e-mailed my attorney but she's on vacation until next week. I have my 140 approved and am not sure what next step is as my fiancee's j1 2 year HRR is not up until Jan 2008.

    Is immigration a right? ABSOLUTELY.

    Well, over the past few months we have heard a lot of sound bites like �Immigration is a privilege, not a right�. �We are a country of immigrants but we are also a country of laws.� We will see about that in moment when we look at history and find out how lawful immigration has historically been.

    Let�s focus on one thing sorely missing from our community: The sense of entitlement.

    A lot of employment based immigrants in this country, legally here, on H1, L1, J1 etc. have asked themselves, �What right do I have to ask for change in laws or relief from congress? I am not even a citizen. Lobby congress? As an alien? Are you kidding me? Do you want to get deported? Do you realize you are going �against� the Government?�

    Therein comes the lack of sense of entitlement.

    First of all, legally speaking, there is no distinction between the constitutional rights of citizens and the constitutional rights of those who are non-citizens � legal or illegal. (Non-citizens are also called �aliens�, but I refrain from using that word whenever I remember coz none of us look like characters of Star Wars and we are not green-headed animals with 6 limbs, so I don�t consider myself an alien just because I was born somewhere else on the same planet).

    Second of all, as a person within the jurisdiction of the United States, the first amendment actually prohibits the congress from making any laws against stated rights � one of which is the right to petition the Government for redress of grievances. So not only its legal to do what we are doing, it unconstitutional to pass a law to make it illegal for us to petition (or lobby, advocate, litigate) government for a redress of grievances. And that first amendment isn�t changing, coz to change it, its going to need two-thirds of US congress and three-fourths of states to back it. And we all know, how lucky we are to have 51 senators agree on the fact that sun rises from the east.

    Earned Right or Birthright?

    The fact that you are here and you are here legally and working with the system to earn immigration is something you should be proud of. Not guilty of. If you treat yourself as guests, the government will treat you like a guest. I would rather treat myself two times the citizen. Why, coz it simply much harder to earn a citizenship than to be born into it. I believe that not only we deserve fair and speedy immigration, but also when we do become citizens we should have the privilege to give two votes in elections. Now, I am not trying to display chutzpah here. I am going to back up my claim with reason. See, a lot of us came here 5-10 years ago with almost no money. Many of us never received any formal education in America. However, we have been able to survive and keep a job in this country, even during the stock market crash of 2001 and the economic recession after that. No small feat. We are the last ones to leave the office at night (Actually, that is true for both legal and illegal workers, coz the legal computer programmer is still coding Java at 7:00 PM while the illegal janitor starts vacuuming the office). We relocate across states as-if its relocating 2 traffic lights away. We adapt to different employers, we adapt to all employers. And all these without driving down the wages. Yes, it�s true. We don�t depress the wages and we don�t steal jobs and the labor certification is designed to prevent that and it�s working. We all know how great its working and how intense the process is, especially those who are stuck in Philly and Dallas backlog creation centers.

    So, to sum it up, we have twice to right to petition the government for a redress of grievances, twice the right to everything. It�s an earned right, not a birthright. Our natural instinct should be to exercise the rights we have earned. If we cannot do it now, we are not going to really make anything out of citizenship of Greencard that we are pursuing.

    And coming back to the sound bites about privileges and �Nation of laws� coming out of Washington today, let me say this: The pilgrims, who dropped anchor near Cape Cod in 1620 didn�t go through a port of entry and get their passports stamped and their I-94s stapled. I don�t think the Indians were waiting at the coast of Virginia to stop immigrants. They just came. And they settled. And they called it home. No priority dates. No visa bulletins.

    So you see, what really matters here is whether you feel you are entitled to something or not. If you don�t feel entitled to a fair immigration process that does justice to those who seek legal ways to immigration, then you probably aren�t entitled. To ask for something, you must first believe that you deserve it. And to show that you deserve it, you must ask it loudly and clearly from rooftops. Don�t predict visa bulletins, but work to change and influence the visa bulletin 6 months from now. And no, you wont be deported for exercising that constitutional right.

    I don't know why but we tend to be satisfied with lsmall benefits...
    I agree with you "something (EAD and AP) is better than nothing"
    But i bet you ..you will find your self in the same situation of agony and endless waiting for the final Green card.
    I bet most of the people don't use your ead and AP as it puts you in a gray "Adjustment of status". They are good to have though. But you will see...how painful it is to decide to use them or not..

    What i want to say is that being able to apply for EAD and AP is not the end of the battle..you will be stuck in a depressing situation waiting for the final green card.How do i know? .. I went through it...waiting for GC for the past 4 years.

    I dont know its FBI or its just the USCIS incompetence but waiting in the final stage is horrible. Every time you travel you are scared...AP as for as my lawyer goes IT does not guarantee 100% entry in to the country.

    After you apply for AP its only 1 year H1 increments.

    What i am saying why dont we try for the overall improvement of the GC processing. Why dont we be firm about not wasting the GC numbers and recapturing the unused numbers.

    We had a small revolt (peaceful way) and its successful.We dont want to stop there.

    LETS FIGHT FOR THE OVERALL IMPROVEMENT OF THE GC PROCESSING

    I agree. The short term relief will be short term. After a year or so we all will be frustrated with the delay in getting GC as that point we will already be tired of renewing EAD (and Advance Parole??) every year. We must work on capturing the unused visas. Otherwise the feeling is correct, no GC for several years after filing.

    USCIS allowed filing but there is no guarantee they will open those envelops and starts working on that. They have a good excuse and that is called THE BACKLOG. I think we should suggest Dipa Nair to make a move named "The Backlog" and I am sure bollywood in India can do a nice entertaing job for that as well.

    One of my friends who is in Canada for a few years now tells me that the Canadian companies do recognize US experience. Another friend recently finished his MBA from the US ( after he went through the whole MS, job at a top company, GC process where labor got rejected after 4 years nonsense). He moved to Canada with a job offer, so it is much easier for him. Just don't go there and think you will find something. Make sure you have a job offer and only then go there.

    Cannot argue with your experience. But I still think providing a convenient automatic way to pay small amounts for a specific period of time will help. (the suggestion of $30 over 6 months or 60 dollars over 6 months etc.) Sure people can do it on their own, schedule it, remember it and have the will to do it et al.

    But when I put myself in the donor's shoes, it feels like the old times when there were no automated payments for electric bills. :D


    This has been discussed umpteen number of times, but I am going to share a personal experience here (shared once already on a similar thread).

    For the last state chapter (Diwali Mela) event in North CA we were accepting ANY AMOUNT for a contribution, but were suggesting $25 or $50.

    How many contributed? About 20 from a state chapter that boasts of 150+ members.

    The fact is, people do one of the following:
    1. look at the recommended amount and contribute that amount (most of our donors were $25, and a few paid $50)
    2. pay a high $ amount simply because (s)he is convinced he wants to help as much as possible! (Most of the volunteers for the event paid $50 or more, and three of them paid $90/$100 each)
    3. DO NOT pay, no matter what, as they are not convinced it will help reduce their waiting time

    One more time... IV is not turning anyone away. If you can only contribute $10 a month, please feel free to paypal it yourself to donations at immigrationvoice.org

    Like the squirrel who helped Lord Rama construct the bridge (sorry for making this a slightly "Indian" post, but can't think of a better analogy) every small bit is going to help IV, and will be most appreciated!

    However, the bridge to the GC is a long one, and our Lord Rama (IV) needs thousands of hard-working and contributing monkeys to make it a reality:D
