    Sorry but i dont agree if you call the consultants sleazy or any other thing.
    Read again. I did not call the consultants sleazy. Also, I did not generalize them. My support is followed in the second line.

    Everybody fights to survive here and they are taking a risk at their own cost hence they are benefitting.
    To me, this statement does not really deliver anything substantial or meaningful. Can you please reiterate?

    I donno whether you would not take a eb1 if uscis itself offers u one ?
    Again, this statement does not serve as a counter-argument because this is a fictional scenario and does not hold importance here.

    Anyways may be you arent lying but check your company ..all the big
    companies do creative accounting tell lies to share holders and what not ..does it make them any inferior or superior ..in the end behind every success there are things that are right.
    This is not an argument about accounting principles. Even if I tie your statement to my points, it does not compute. I am against labeling and generalizing EB-3 and I said that in my post. Please read my post again.

    So even people who applied in eb2 did somethings right which enabled them to get qualified under it.

    Dont be a crybaby ..be a man ...u american graduate take risk or show ability to qualify under eb1.

    there are two factors here:

    1. Regarding consultant coming to US. As employer told he does not have bonafide job offer. he is at 0% fault and consultant 100%.

    2. Regarding paying for h1b fee. employer obviously did not make money here but he was not supposed to take money from consultant.

    it's all about greed on both sides.

    You do NOT have to go anywhere - what you are saying is "SBI Rapid Remittance" by SBI where the money will reach your Foreign account the very next day ( But you might have to wire the money as well to BOA-NY or SBI-NY ?)

    In this case the guys as he "claims" appears to have come here without employer calling him. And is trying to complain against. Who will be screwed up. The employer can easily say he anticipated, but no project no, so didnt get the guy to US, as its legally allowed not to get.
    Again, I STRONGLY feel this thread, and the similar, are all in an effort to divert our attention. Just stop these by not bumping them, with our comments. Let mine be the last.

    Robert, you are WRONG in your position. Actually it is not my vision of situation, it is vision of the USA law.

    Empoyer MUST HAVE WITHDRAWN H-1 if H-1B job was no longer available and he DID NOT. He did not promptly respond to the employee, so employee had to stick to the pending agreement and COME to the USA on the designated date, for his own money.

    After employee came to the USA employer benched him unpaid, still not revoking H-1 or paying salary as he is supposed to do by the LAW.

    Now he must pay employee's tickets to and from USA as it is also required by LAW.

    Probably it's kind of costly for just "silence" in the email, but it may be VERY costly for the employee to come - as he may had to end his lease in home country, cheaply sell furniture or have other damages connected with this travel.

    Also there is still a possibility, that employer is a fraud, who takes $4000 from employees, applies for visa, and regardless of it being approved or not keeps $2000 from every such application. It's not that little if he applied for let's say 10 or 20 employees.

    So I think Alex MUST report the employer to DOL.
    Alex should also file police report to check if there is a fraud going on.

    Actually some of them are still as committed as they were prior to getting GC. waldenpond still runs the organization with the same vigour. franklin and others have got their GCs but still stand as pillars for IV.

    No. It's not a typo. I had met Aman in a conference in December. He was talking about selling his house to contribute to IV (I really hope he didn't have to). But he has contributed a small fortune to this effort.

    Do you know if they have a record of everytime we talk to the CSRs?

    I have only been able to talk to an IO once, and I feel they definitely have more info than these CSRs who are sitting there like bots. To get to the IO, I basically had to tell them that I have not opened a SR so far (which was not true).

    When I tried calling yesterday, I told the CSR, that my attorney opened a SR on 1st September and if she could kindly transfer my call to a IO. She said she will not be able to transfer my call, as I had already opened a SR. When I told her that I already got a response for the SR, so I now need to open another SR, she said she cannot as it asked me to wait for 60 days. I requested her a couple times to please transfer me to a IO, she said, Sorry, cannot do it as you have already opened a SR.

    I am planning to call them next week again, will tell them I have not opened a SR yet. Atleast, I will then get to talk to a IO.....!!

    It is important to do the homework and choose the school that fits your needs, if you want to get into finance or marketing or... go to a school that is know to be good in that field, you will still meet many people in other fields but the majority will be in the field you are interested on.

    BusinessWeek website is good for reseach, but don't limit yourself to that.

    Getting accepted is the most difficult part. Once you are in you can pretty much say you have the MBA. The GMAT is literally a pain, many of the questions are tricky and you need to learn the tricks.

    Try to go to a name school, you are investing enough money not to go to a school that is not going to help you move a step ahead (through the name of the school or through the people you are going to meet). I have a friend that goes to a no-name school and they just accept anyone so the friends you make are definitely not that ambitious.

    NOTE: the CEO of my company (6K employees) got his MBA at Wharton (he's a PhD as well) and he hired as CTO one of his friends from school.

    Filing the complaint is the easiest thing that I have done in a long time. As I had lots of written evidence so it took me close to 30 minutes to prepare the everything but normally it should take no more than 10 minutes. The DOL, Wage and Hour division, takes care of all the such complaints and the identity of the filer is kept confidential to the fullest extent provided by law.

    The Form for instructions for filling the complaint & the form is available at http://www.dol.gov/esa/whd/forms/fts_wh4.htm list of H-1B willful violators is available at http://www.dol.gov/esa/whd/immigration/H1BWillfulViolator.htm and the list of debarred employer's is http://www.dol.gov/esa/whd/immigration/H1BDebarment.htm

    When I filed a complaint, I sent the whole package via FedEx. I waited for few weeks to hear from DOL but when nothing happened I went to their office (they are few blocks away from me). I spoke with an investigator (who was very professional and courteous) who told me that even though FedEx shows the package was delivered they cannot locate it. The investigator asked me to resubmit the package which I did the next day. I received a letter from the DOL after 2 weeks saying my complaint has been received; they even assigned me a complaint number which I can use to track the progress of the complaint by calling their office. The DOL combined mine and my coworker's complaint together and assigned both of us the same complaint number; my coworker filed his complaint few days after I had filed mine.


    What exactly happens to them?
    Are they under a watch list?
    Many employers will open up a new company and operate?
    Maybe employers are ready to deal with this ????
