Though most people here would want retroactive action, I think such a rule will only be applicable for applicants based on a cut off date that will be a future date.

Thats how all laws have been in past.

This is something that is most unwelcome by employers and lawyers and thats why this may have opposition. Especially those consulting companies that thrive on these things.

My name check is pending since March 2004.

Are there only 3 people suffering from namechecks?
This issue can be pushed if we have strong support for it.

Many folks suggest that this BIll (when turns into a law) would promote outsourcing..but how does these set of changes being proposed by Odama's admin. would affect outsourcing??

    http://thecaucus.blogs.nytimes.com/2009/05/04/obama-takes-aim-at-offshore-tax-havens/?hp

I know it wont "stop" outsourcing in any way but seems like they claim that they are " taking away the tax advantages of companies shipping jobs overseas"...Iam sure its more complicated than that..

However the kind of tone being set by the incumbent these days, I believe reflects the current administrations policies that might trickle to us(documented workers) as well.. not sure..

However this can be also looked at, the adminstartion si trying to "show" that they are doing whatever they can disccourage companies from sending jobs overseas..and then eventually take a stab at CIR..wishful thinking..:D

Mr. Dobbs is known for his strong views against immigrants, including considering immigrants to be responsible for the spread of incurable diseases such as Drug-resistant Tuberculosis, Leprosy etc. From past experience on CNN, he is also highly likely to blame the current crisis in Auto Industry to the so-called "importation of cheap labor from third world countries".

Lou Dobbs Tonight 03/28/2007 (http://transcripts.cnn.com/TRANSCRIPTS/0703/28/ldt.01.html): "It's pretty remarkable. Four hundred thousand H1 visas each year."
From How many H-1B visa workers? Counts vary (http://immigrationvoice.org/forum/showpost.php?p=114543&postcount=737) VALLEY EMPLOYERS AMONG TOP USERS By Chris O'Brien (cobrien@mercurynews.com or (415) 298-0207) | Mercury News, 07/15/2007

The federal government awarded 124,096 H-1B visas in the fiscal year ending October 2005, the most recent annual totals available. That includes renewed visas, which don't count against the annual cap.
From Characteristics of Specialty Occupation Workers (H-1B): Fiscal Year 2005 (http://www.uscis.gov/files/nativedocuments/H1B_FY05_Characteristics.pdf)

Page 5: Number of H1B petitions approved for initial employment is 116,927. The number of approved petitions exceeds the number of individual H-1B workers because more than one U.S. employer may file a petition on behalf of an individual H-1B worker.

Whether to remain in H1b status is a personal choice. There are a lot of considerations in this. Whether you want to change employers, whether you want to take on an extra job, whether your spouse wishes to move from H4 to EAD and get a job. How shaky your job situation and petition are.

Generally however, if you have had your 140 approved, have your receipt notices and have gone through the fingerprinting/security checks and it has been a long time pending where it is likely your 485 has been through the initial internal processing, then punishing yourself by not availing yourself of the relative employment freedom that the EAD offers might be considered too timid. However, that is just a view, it is essentially an individual choice based on your circumstances. Many people often stay in the H1 status until it expires if things are going OK, as not "rocking the boat" seems like the path of least resistance in times of uncertainty. When the time comes for H1b renewal however, other issues like, cost, waiting time etc come into play, and I have seen many people then choosing to just go with EAD/AP which as someone pointed out they often have already. Then as time passes, they figure, oh well since I'm on EAD/AP already I might as well go for another similar job. As months and years go by in this 485 limbo, these type of choices become more and more necessary.

Then you hear about issues like this and you wonder whether EAD means anything in this country and feel H1b might be better.

    http://immigrationvoice.org/forum/showthread.php?t=15620

I'm just pointing out some issues in this debate. Each person should perhaps discuss this with their lawyer before making a decision. Most folks here are in for waiting times of years absent congressional intervention. Once congress is adjourned for the year and end of year appropriation bills are completed, not much is likely to happen before 2009 summer at the earliest, implying 2010 by implementation. That said, perhaps this should weigh into considerations as well, I mean 2 1/2 more yrs is a big deal and may be worth the small risk.
Of course we all hope for something before that, however we also need to be realistic and see that this retrogression monster hit in 2005 and 2 1/2 yrs later we have got no proper fix to the retrogression issue, more awareness yes, but the political climate is very difficult.

I dont see any issues here. he is applicable, he has required skill and education. he should be file for EB2
The fact that he's asking whether he qualifies for one, on an online forum, shows his level of skill and education. Enough said :)

PMP is a good idea. But is that what you exactly want to do? Figure out. I work with PM's every day and in my company it is a pre requisite for every PM to have PMP on Resume before the Hiring Managers look at their Resumes. How ever, I personally feel that the project manager's job is mundane. Some times I even wonder whether these guys know any thing other than putting some M$ docs and ppt shyt together (doesnt hold good for all PM's) with all the info they gleaned from their managers and others in project. Is it that difficult? May be, this is happening in my company only or I am being blind because they do get paid in 6 digits. But it will definitely help you grow in an organization esp in the managerial ladder. You gotta lose something to get something. I am seriously considering taking up GMAT prep but my situation holds me back as my wife cant work.. blah blah.. What ever.

No It was not a joke.

If you think you earn way more then go ahead and contribute more. I just put dollar amounts in front. Many desis here work at 55-65K per year and that is roughly $30 an hour. The ideas is get off your high horses and earn money through sheer labor to get the job of funds done. I see no problem with that.

Hey, dude, I hope that this was a joke :D

Because I doubt that anyone willing to wash my car for a few bucks is highly skilled. Personally, I prefer, give 1 day of salary - that's way over $25, and far more effective (I get paid more than $25 for the time it takes to wash a car).

    [edited]
Huum, I rather thing that it was not a joke. No offense intended.
The dinner and movie is the best idea.
Actually I think that the other ideas to be "less than optimal", thus I thought they were a joke.

My M.C.A was 3 years. this will help?

    -vga

Check with the educational evaluator. They are the one who will let you know if your 3+3 years degree will qualify with educational requirments for EB2. Of course you could get a negetive answer also but it is money well spent
Based on the educational evaluation take the next steps

Sen. Jon Kyl, an Arizona Republican who worked with Kennedy to negotiate the compromise, said he will push to allow more temporary workers into the United States if they are needed.

Also on Thursday, the Senate voted to raise the fees businesses pay for visas for highly skilled technology and science workers to $5,000 from $1,500. The money would be used to finance a scholarship program.

The Senate will complete its consideration of the bill after lawmakers return from a week-long break. The U.S. House of Representatives is expected to take up its own version perhaps as early as July.

WHY is she backing the bill..what is her motivation? or did she just decide to do a gandhi on us all?

    > i am not berating anyone for that matter!

When lawmakers support certain bills..its because of the interst groups that back them..not their inner calling!

"If that is the logic then why do you think that lawmakers will work on "immigration" bills. After all the "immigration" bills only benefit folks who don't vote immediately. "

HR 5882 and HR5921 not only help alleviate ( I am not saying eliminate) backlogs in EB, but also help reduce (Not eliminate) FB backlogs by doing a recapture and carrying over the wasted visa numbers. Do I need to say more on to whom FB matters the most? Don't you think the members we called have an interest in supporting these bills? If you think that only lobbying using those high tech firms helps us get out of this, you must be dreaming.

    Hi,

The best thing that you can help us do for now is to recruit more members, and get them to pay IV. Trust me, membership and funding are two of the biggest challenges in front of us. Beyond that, if you would like to help further, send me a message, and I'll see who I can put you in touch with.

    Thank you again!

    Best,

    RR

We need more members to join IV. In order to help us, pls--

    - post IV poster in your local grocery stores, temples and restaaurants. (the poster is in resources section)
    - try to get friends from other nationalities to join IV.
    - If you are a graduate of A US university pls contact your alumni association and inform all their members.
    - Send an email to all your friends. (template in resources section) informing about IV

    Oath of Allegiance

    The oath of allegiance is:

"I hereby declare, on oath, that I absolutely and entirely renounce and abjure all allegiance and fidelity to any foreign prince, potentate, state, or sovereignty of whom or which I have heretofore been a subject or citizen; that I will support and defend the Constitution and laws of the United States of America against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I will bear arms on behalf of the United States when required by the law; that I will perform noncombatant service in the Armed Forces of the United States when required by the law; that I will perform work of national importance under civilian direction when required by the law; and that I take this obligation freely without any mental reservation or purpose of evasion; so help me God."

In some cases, USCIS allows the oath to be taken without the clauses:

". . .that I will bear arms on behalf of the United States when required by law; that I will perform noncombatant service in the Armed Forces of the United States when required by law. . ."

Question: Once one takes US citizenship s/he promises to renounce and abjure all allegiance and fidelity to any foreign prince, potentate or state then how come one confidently say that s/he would still be in love to a home country?

Seems like everyone here hates ICICI... I have been using ICICI for 8 yrs now...Had no issues transferring money..... They might have robbed me few paisa from exchange rate but i did not pay that close attention as i found that exchange rate at remit2india from times and Citi was always bad compared to ICICI. I do know about their bad practices in India where they force people to have min balance of 10-15 K and so forth. I think its time that RBI makes gets rid of min balance requirement or put upper ceiling on it. Having such a large sum (Equivalent to 2K USD when considered Purchase power parity) is ridiculous and kind of stealing of people's hard earned money. But again, ICICI is not the only one doing it so cant single them out.

After reading so many bad reviews about ICICI, i would like to check out SBI service, but not sure if they allow direct deposit in banks other than SBI? my parents are with IDBI so it is very convenient to have ICICI transfer money directly....Please advise
