There is something called as recapturing of lost Days on H1. So for example you were out of USA for some time when you were on H1 you can recapture that period. Try googling "Recapturing of H1".
This way you will not be part of the New quota. Hope this helps

Is there any quota on filing the I 140s? My friend requested his employer for upgrading his 140 and he says that the attorney mentioned that the quota for I 140 is already full. I don't think it is right. Any inromation please.

As per my understanding here is how it is supposed to work

- One ONLY has to say whether he/she is Authorized to work for any employer in an unrestricted manner

- One ONLY has to say if he/she has a security clearance

- One ONLY has to say if he/she needs a visa sponsership now or in future

- Certain jobs may need that one has to be a US Citizen (not sure about this) - but there must be a valid reason as to why the job needs a US Citizen

Once an employment is offered, the employee has upto 72 hours from the day of joining to provide proof of work authorization and complete the i 9 form. The authorization must be original and the employer must verify this and take a copy and place it in the employee's folder.

This is very important because - due to economy, a lot of employers are coming up with arbitrary rules and applying arbitrary filters and will continue to do so as long as it is not challenged.

I am in the same boat and need to post the paper in the next couple of days. Can somenoe please help me. I would greatly appreciate your help.

My priority date is Oct 2005 and i applied for i485 (EB2) in July 2007. I am planning on filing i-485 for my wife as a dependant/derivative of my application on August 2, 2010. My i-140 is approved. My case is pending at Texas Service Center. According to the i485 instructions and USCIS website (both revised on 12/03/09), the application has to go to :

2501 S. State Hwy, 121 Business

Lewisville, TX 75067

My lawyers office informed me that the address to post is:

4141 N. St. Augustine Road
Dallas, TX 75227

I couldnt find this Dallas, TX address on neither the i485 instructions form or the USCIS website. Can someone who filed recently (after 12/03/09) to Texas Service Center confirm the correct address please. It would be of great help since i need to file the papers in the next couple of days.

Sorry for the post outside immigration boundaries.

My wife with 2 toddler kids will be traveling to India via Lufthansa.

I wanted to know from recent experiences how many check-in bags are allowed per person. My kids are 4 yrs old and they have a full ticket.

I know that some airlines only allow 1 checking per person, but wanted to know about Lufthansa specifically.

I could not find a clear answer on Lufthansa.com for baggage allowance to either India or Asia.

As long as a person is meek and weak, that's what we get - Nothing. With AOS pending, every person in most states are bound to get 1 year renewal..Period. Be forceful but polite in expressing it. Take it to the next level - Supervisor.Ask what they mean or definition of "old I-485". Tell them you are Paying all Taxes (Federal, state, Social, Medicare.... ).

By the time you come hear, mostly probably, the agent might have approved a 1 year Renewal.

Seems FAIR is slowly creeping into DMV also.

Doesn't your RFE letter says it clearly? They mention a "reply by date" also on the letter.
