I guess USCIS is getting pretty smart. To be a plaintiff in the lawsuit, your application has to get rejected. By holding your application, it is probably preventing you to be a plaintiff. Smart F***ing A**es
It does NOT need to be rejected. It can be rejected, or, there is a reasonable expectation it will get rejected. This is established by USCIS press release that they will reject all applications. Thus, the applications can sit there and the lawsuit will move forward.

My wife appeared for Visa interview on 6th and yet to receive the passport. we booked tickets for this weekend and seems we have to reschedule. I sent a mail to NIV and no response as of now.This is of concern. can anyone tell me about the normal turnaround time for H4 Visas these days?

Ok, among the many replies to what i wrote, a few have been rational discussions. A healthy argument is always encouraged. However, I will dissect the above post line by line to pinpoint exactly why some people completely deserve the treatment that they get. Here I demonstrate how a healthy discussion is hijacked by imbeciles and that is why IV is doomed to failure.

Today we might not be responsible for that, but I am sure lot of us will do the same after getting (if ever we get it) the Green Cards i.e. open such a consulting companies. Also we do not hesitate to call one of our friend, relative etc through one the tricks mentioned above. Finally many of us work or worked for such companies and let all these happen in these companies.
The sad part is that big companies like TCS, Wipro also do similar things, so why blame small desi companies.
A lot of people are responsible for these happenings and a lot of people are responsible for exposing all this. Its not one person or one organization here in play.

If citibank is good, all should move to citibank if they are fair in runinng business.

Second the idea of using an ATM card for this purpose. You can get an ATM card for your parents or relatives in India from your local credit union or bank in the US.
How does this ATM thing work? Do you give your family in India your own ATM card/PIN or do you request the credit union to issue ATM cards for your family.
I just checked with the credit union I have account with and they said, to issue ATM cards to anyone else they (the person) should have SSN# and they should be made joint account holders. This is not possible when you are planning to give the ATM cards to people in India right?

This is an excellent question and I was also looking for an answer. I am into my 6th year of H1-B(exactly 5 years 1 month) and also have an approved EAD & AP.
I have a great JOB offer but hesitating to invoke AC21(moving using H1-B/EAD) because these days there are many 485 DENIALS( the moment I1-40 is REVOKED). And NOTHING is guaranteed even if we send the AC21 documents to USCIS. And the EAD automatically gets invalid anyways when the 485 is denied.
Doing some research to find out if H1-B extension beyond 6th year is valid if 485 - gets DENIED? (Example: If I get a 3 year H1-B extension based on my current I-140 approval)?
Also not sure if it applies in my case as I still have 10-11 months of H1-B remaining and if I decide to take up this oppurtunity in the next couple of months and 485 gets DENIED after that. May be I will have enough time to file MTR? I should be fine. But what if 485 gets DENIED after I complete 6 years?
Please provide genuine answers.
These answers will BENEFIT many people.

some states do consider a foreign student as in-state after one year of residence. but for some other states that you have not been to, if you come on F1 visa, you are international and therefore out-of-state no matter how long your program is..

He contacted his senator to get the total number of pending EB apps for India.
Please see the response from the senator in the following link. It has pending applications by category.

I am working on EAD for company B. Company B filed H1 transfer for me before May 2007. I heard that You can transfer you H1 and EAD both with new company but I did not aware about this rule, I started working on EAD. Is it possible to go back on H1 which company B filed? I have not yet used AP for travelling abroad.
