I am planning on sending some question so the Hillary Clinton Townhall. I will check in with the experts before I send them in
Clinton, Romney & McCain know about EB GC problems; they may not know some low level details. I don't know about Obama.

The questions are very very simple.

What do you plan to do about administrative delays (like labor, namecheck, ...)?

This can be done by the Prez alone!
What do you plan to do about the yearly cRap of 140K?

There is no cRap on F1. There is no cRap on persons hired. Why should there be a cRap on GC?

    I-485 approval should mean GC!

    This needs congressional legislation!
If retrogression drags then H-1B rules (like pay stubs etc) should not be applicable!

    This MAY need congressional legislation!

    Hi ndialani,

Did you contact ombudsman after this? Is there any progress in your case?

I got similar reply from ombudsman but still there is no progress in my case.

    Thanks.

No , i haven't contacted Ombudsman office after that.
Check my earlier post. , I was able to talk to IO at TSC, and he had my file assigned to him the same day. There was a problem , in there system , anf my I-140 was showing
EB-3 instead of EB2. I got that cleared. that was 10 days back. Now , i m just waiting....

I was just kidding on that. I would be more than Happy to see an EB3-I get GC before me with just even a day ahead of me. They are equally deserving.

On that, let's shake hands.. and keep up our friendly kidding.. it's a welcome change for our environment here in IV

Did you consider using "atlas america" and other bunch of travel insurance that advertise themselves as PPO? I am wondering if anyone has expericence dealing with them regarding claims. I purchased that recently for my parents since it had 100/0 or 90/10 coverage.

Anyone has experience going to hospital using these insurance?

Hi I am a physician in Oregon and my parents are visiting too in July. I called Kaiser regarding this, and this is what I was told.
    1. they can get insurance since Kaiser does not need an SSN for the application.
    2. Every Plan has a deductible $, an out of pocket maximum $, and a co-insurance $ amount.

    So,
Plan A: Deductible 2500, Co-insurance 22% of all inpatient cost upto max of $22,000.
Plan B: Deductible 6000, Co-insurance 50% of all inpatient cost upto max of $50,000.
Essentially none of these plans are a 'good deal'. But remember its easier to pay back a loan of 22k - 50k than to pay back 100-200k.
Also since Kaiser is an HMO, and has its own facilities in the west coast and Hawaii, 'accepting insurance' is not a problem.

I have been looking at opportunities elsewhere. However, in my field (not IT related), US is still a very good destination and my skills are also in demand in US and elsewhere. My home country, however, still lacks the basic infrastructure needed for me consider that as an option.

Nonetheless, as I said, if things don't improve by 2009, 2010 then I will be forced to consider other options such as australia/europe/canada. But I dont think I agree to "Quit America" just to prove a point. I will do what I think is best for my career and future; as the congress must do what they think is best for America's future. If given the chance, I will contribute to the continued success of this nation... else will move where my skills are in demand.

Meanwhile, get invoved in state chapters to convince congressmen about our plight, and let them decide about the country's future.

If you heard what the restrictionist lawmakers have said about what to do with illegals, this retrogression makes sense. The restrictionists want to make life miserable for illegals by making it difficult for them to get jobs, this way the illegals would go back on there own.

They are trying to do the same thing with us legals (without saying it aloud). If you are from India it will take you at least 6 to 8 years (if you are lucky) to get a green card. Frankly in the fast changing technologically advanced world how many people can hold on to the same job for 8 years straight, they cannot. People lose jobs because they are laid of, the company has run into bad times, the technology has changed and the company wants to move you to a different role or position etc, this way a lot of people have to switch jobs which invalidates thete green card process. They are making your life miserable so that you are broken down psychologically and finally will go away either on your own or because of some arcane rule, example the labor should be applied more than one year before h1 expiration etc, a living example is that Indian guy who posted recently that he is leaving US to work for Microsoft in Canada. This way they get the best of both worlds, you have young people in the prime of there life without any diseases who do not burden there medicare system, working hard and paying social security taxes and medicare taxes (which they will not get back) and in the end they are kicked out or go away on there own.

I smell a huge conspiracy behind all this USCIS, DOS mess. I believe the only reason they did is to make legal immigrants life miserable. They did all this so they waste EB visa numbers again this year and make legals wait for years before they get LPR. By the time the an individual numbers comes for the green card some of them might become illegals and some after years of frustion have gone back home.

Core members please ignore such posts. Please continue with your great work.

    Purplehazea:

I didnt know you have such doubts about the efforts of IV and its goals.

Anyways, have you every picked up the phone and called us to ask us what we are doing at that moment? What we did last week, what's our plan next week? You know, there is a phone number listed at several places on the website. That phone never rings. Oh yes, never. So who come you never seek answers where you can get them?

We have told several times, that we dont have time to keep everyone in loop about everything we do in DC, including every time we meet some staffer or someone. Sorry, that's just how it is.

Last week, Aman was in DC on Thursday and Friday (Jan 25 and 26) and had meetings with 3 senate staffers who work on Immigration. Then he went to India, then he came back straight to DC monday morning and since yesterday, he has met with 2 more staffers, our lobbyists.
We are also trying to find out about the schedule A rumor and if its true, to have the recaptured visas go to all categories not just schedule A.

So there, you have your update? If you want to know more, then call us on the phone.

And this update is the kind of update we dont usually post on forums. This is mundane advocacy stuff. Find me one organization that gives hour by hour update of what they are doing.

If you dont trust us, what are you doing here. Why dont you join the "bash IV" party at immigration portal and enjoy criticizing the arrogant IV core and its stupid blind followers. I am sure you will find many enlightened fellows like over at portal who are smart enough not to follow or believe in IV.

Thanks ak27... based on your suggestion, I have started enquiry on my case through congressman.

I also talked to second level I/O and she told me that it may be due to pending biometrics (what a relief to hear that). She didn't give me any other details so still not sure what's going (no SLUDs yet). I haven't recd any finger print notice since my first one in sep'07 so that kind of makes sense.

I had a infopass appointment today, IO informed me that my fp expired so that may be the reason for not approving I-485. He told me that my application had some activity on July 29. Later I contacted my congressman's office and they informed me that my fp will be refreshed and I dont need to take new fp.

EB-3 India is last in the line so first EB-2 (WW) than EB-2 India/china/mexico, then EB-3 (WW) then EB-3 India/China/Mexico... basically my common sense tells me EB-3 India will get a big 'ZERO'....

There is a spillover of 22000 visas from FB to EB starting Sep 01 2008. Does anybody know how this spillover is divided between EB1/EB2/EB3?

Can we expect 28.6% of this spillover in EB3? Just like we get 28.6% of annual quota?

    Hi
Can you please tell me who you addressed the letter to (letter to the president) - is it just the address given on the WH website. Did you send it to anyone's attention in particular. Thanks in advance for the info.

    The President George W Bush,

    The White House

    1600 Pennsylvania Avenue NW

    Washington, DC 20500

Mention in the subject line: FBI Name Check pending.

Also send it by a regular post as I have seen and it worked for me, whether it was the FL, State Senator or the Local Congressman !

Also make it a point to write at the top of the envelop (Immigration Assistance). Let the letter be very personalized and write your traumatic experience.

    All the best !!!

For all of you who have send me a pvt. message asking me how to reach IO @ TSC, here are the steps:

    1) Call Customer Service @ 1 800 375 5283
    2) Continue in english, hit 1
    3) To check the status, hit 2
    4) Know your receipt number, hit 1
    5) Enter Receipt number, and then for SRC, hit 1
    6) Confirm Receipt Number, hit 1
    7) You will now hear the status of your case. At this point, hit 3 to "Report a problem".

Here is the trick - now you will hear 4 options. I believe # 3 is "If your case is outside the processing time..." and # 4 is for "If you have filed several cases and have received a decision on....". You want to hit # 4 and you will be connected to an IO at TSC.

Just a word of caution: You will be talking to an Immigration Officer @ TSC so please be very polite. Some officers will tell you that they cannot give you any information, or you should be calling Customer Service number, simply say 'Thank You' and hang up. It might take days/weeks before you reach an IO who would be willing to help.

    Again, the sequence is:
    Call the customer service number.
Press 1, 2, 1, Enter Receipt Number, Hit 1 for SRC, Hit 1 to confirm RN, 3 to report a problem, 4 to connect to an officer @ TSC.

Also, you do not have to wait to hear the complete message. You can be connected to an IO in less than 30 seconds (trust me, you will get good at it). I had the print out of steps sitting in my car and I would go to my car every 2 hours and call TSC. Keep a log of when you called and who the officer was (if the officer tells you their name, note it down cuz next time you can simply hang up if the same officer is on the line).

PLEASE DO NOT WASTE TIME CALLING CUSTOMER SERVICE, AND DO NOT OPEN TOO MANY SRs.

    Hi All,

You know my old H1B case was reopened on Sept. 28, and the USCIS Emailed me that they sent a notice. But I haven't received such notice, my employer/attorney also didn't receive any notice. I wonder the USCIS didn't send this notice at all!
The best way to find out the reason for reopening is to call USCIS. But since this is a I129 petition only the employer or the attorney can get any information since USCIS will not disclose any such information to the beneficiary. If the previous employer agrees to call USCIS, things will be clear.

Mr chaanakya, You may find this as a personal attack! But it is not. This is an attack on your thought process!

You claim that you received a PHD. But I seriously doubt whether the university that decorated you with a PHD evaluated your ability to think rationally and ability to reason!

Normally with education people achieve wisdom, knowledge, ability for rational thinking, ability to reason, humility, compassion and a better understanding of the functioning of the world.

I am not saying you do not have the right to complain or right to protest. You have and you definitely should have. But the approach that you have taken is the wrong one! In your post you criticize about people lamenting their plight! In reality, you are also doing the same, Am I correct?

If you are a real PHD, just go through the following post that you presented and analyze how you can improve that to make it a product from a REAL PHD!

If such an educated guy like you can become an opportunist, how you can expect higher standards from lesser mortals!

In another post you said that you were eligible for EB1 and couldn't go through that rout, are you lamenting here? If you are well qualified, why didn't you go through that rout?

    You said:

"You have all the opportunities that were/are available to a person who sweated it out in the university system here to gain more qualifications and get an EB2 job."

In the same token, Why you are not trying to achieve a suitable job at a suitable firm which will apply your GC in EB1? You have all the opportunities for that, right? Why can't you achieve a Nobel prize and obtain GC in a split second? Who is stopping you?

Just because, you did your masters and PHD from here, does that make you special? What about a guy who obtained Masters from G Britain? - Is he ineligible? Would you prefer special treatment over him? The point is, when you came here, you swore that you do not have any intention to immigrate, and you just have intentions to study and return to your home country - Try to remember, you did that in your F1 visa application form. So, my friend, nothing gives you a right to be here or to get GC. It is a privilege.

You need to understand one thing: Each person has different skills, living circumstances, responsibilities, and different type of blessing from the almighty. So, don't measure everyone with the same yard stick that you are using to measure and don't use your own selfmade standards.

If undocumented immigrants where also competing with you for a GC spot, you would have said, they also have the same opportunity here, why they are not taking masters and PHD to get their GCs sooner?

In reality, some are fortunate to reach your level, but not everyone! But that doesn't make them ineligible for the Pursuit of Happiness and Pursuit of a better life!

If you do have a real PHD, you should lead, you should be a role model for many and propel your energy in the positive direction instead of a stupid post like this! You can work to make things better in this country!

My point is, work hard and lead to improve the immigration related laws and procedures!

Last point I would like to mention: Dear friend, Just education alone will not make you a better person or a person with wisdom. Try to learn from life, lives of others, problems of others! I think, if you try, you can understand this better than me, because you have better education!

And please, don't speak for me: I am an EB2 Masters category guy.

Last message to all folks who express their feelings through red dots: Think before you act! Provide the real reason why you are giving a red dot. Don't just allow your emotions to control you.

Yes, that is right, I said “plight of EB2-India”.

I am a passive observer of these forums. But some of the ridiculous notions floating around here have motivated me to vent. First and foremost, the law as written is highly favorable to people in EB3 categories, even from India. Here is how...

Take my example (and there are thousands like myself)....came to the US 8 years ago, spent 5 years working day and night to earn a PhD on a low (barely sustainable) stipend, got FIRST job saw decent money for the first time 6 years after I came.

Now, compare this to a person working an EB3-job for the last 8 years. Not only does this person do a real job that hopefully provides a respectable income but this person also has the option of moving to EB2 after 5 years of experience. So, at the end of the day in 2008; this person comes out ahead of me in terms of money, in terms of priority date (if ported) and most likely in terms of GC.

There are complaints all over the forum which have the stink of pretentiousness such as “oh..i am a poor EB3 waiting for n number of years” etc etc. What you guys seem to forget is that YOU are NOT an EB3, it is your JOB that is EB3. You have all the opportunities that were/are available to a person who sweated it out in the university system here to gain more qualifications and get an EB2 job. You CHOSE not to. The general discussion seems to center around cribbing about the US immigration system (Immigration by the way is a privilege defined by laws, not a birthright) and then blaming the EB2 crowd when they finally see the system implement the law as intended in the first place (horizontal spillover rules).

All these posts that refer to “my career is over because my gc is delayed” are nothing but a pathetic excuse. Law of supply and demand....if you have a skillset that is valuable, you will be fine with or without GC anywhere in the world. It takes a bunch of documents to remain here legally, all you need is a passport to go back if the system here seems so bad.

For all the attacks that are bound to happen, here is the fodder.....this is probably my first and last post, I haven’t contributed a dime to IV, will work here as long as I like it and if not, India is a great country and provides enough opportunities for any skillset !!

That is correct, 9 months and then I will return to my country for good.
I am waiting for the day when we get the GC , we will tear it into pieces and throw in front of consulate.

    Cheers

    You are absolutely right!

It is absurd. You need people, so accept labor application and approve it. Then you authenticate the individual by approving I140. Then because this 'number' not being available you let the individual and his/her family in limbo state for 5-6 years.

The mistake is not on their part; it is on our part. We are so desperate for the GC.

I would blame all the dirty politicians back home who have not let the country flourish and thus forcing the so called 'smart' people to seek residence else where on earth.

It is too much for a social animal to go through in 'its' life cycle.

I understand your frustration. Believe me I have gone thru the same.

When I filed for my I-485 in 2000, the PD was current for me for 23 months in row when it got approved. Can you believe this? PD was current for whole 23 months while I-485 was pending.

One of my goals is to help my future legal immigrants. Being a US citizen gives me vote voice and power. I am open to suggestions. I would like to help my fellow legal immigrants.

I know, the wait time is long, but it is worth it every bit.

    Good Luck to everyone.

Hmmm so you have been a victim of random processing too? The situation is a mess no doubt. But this random processing really hits where it hurts the most...

IF ONLY everyone who gets a GC approval or citizenship could work at the CIS for a year... a sort of community service.... All of the problems wrt the random processing will go away...

I am sure most people on this board can hit the ground running and don't require extensive training... unlike the present day IOs.

My post is going to make few MS/Phd people angry over here. Correct me if I am wrong, but when you came here to do MS/Phd, you came on a student visa...Right? Student visa comes under Non Permanent Non Resident alien category. All of you had a burden to prove to the US consulate that after you complete your degree, you would go back to your home country. All of you prepared for that and you knew the moment you said, I might not come back, F1 would be gone! You said this...every time you went back for F1 visa revalidation. Mind you..that H1/H4 never had that burden. They could have easily said that yes, if I like USA, I might not come back.
Now fast forward....MS/Phd is done. Suddenly...."I will go home after MS/Phd" statement is gone..and hunt for H1-B is on! Once they get H1-B, hunt for Green Card starts. Once this heavy head Phd guy, who spent last 5 years on 1500 bucks a month is in GC line....he also realizes that hey, H1-Bs should not be allowed to interfile. After all, they all work for desi consulting companies. Yeah..right! Look who is talking! All H1s should come in EB-3, after all they did not go through 1500 bucks a month for 5 years.
Here comes a Phd guy who always lied to the system saying "I love my home country, my research would do wonders to the society at home" is not leaving any stone unturned to get his GC (faster than anyone else).....tell me, who is inferior? A Phd student who lied to the system for 4/5 years and suddenly changed his intent or an H1-B candidate who never had the burden to prove that he would go back.

All of us are part of this very painful journey! I have spent 8 years on H1-B and I am still waiting for my GC. I work for a desi consulting company, my GC is in EB-3, I have a B.Tech. degree from IIT and I am sick and tired of this GC mess.

Second this post - point is, there is no easy solution to this mess until we work together to achieve the common goal of increasing # of visas available for Green card.

I am not sure if you are being facetious but I think that is a great idea! :)
No, I'm not being facetious :)

There is always a chance that a well publicized (we are working on that part!) rally might attract opposition to the rally.

I wholeheartedly think that this gesture would be seen as fairly "american" and could defuse tension if it arises. Plus it would link back nicely to the flower campaign as well, and the eventual destination of the bouquets sent.

Political stance on wars aside, I don't think there are many people who don't support the lives on the line.
