There is one more thing that not many people are aware of.
Let me ask eveybody. Even after all this, why are these Desi consulting companys successful in the market? They have poor quality product (People with forged Resume), they are not charging lower rates, but still they are able to put there people in Projects?

Mom pop brother companies file for GCs for relatives who work in gas stations, these are not to be compared to regular staffing company. These mom pop companies are formed by immigrant community of various country immigrants in association with lawyers who exploit a loophole in the system. These are not restricted to Indians in general. One morre thing is contract marriages, where agencies + lawyer arrange a contract marriage and get the person here and get citizenship. These are more common with mexican, latino agencies.
A lot lot of shit can be talked about people who want to immigrate in some form or the other, thats why I say "hypocracy" or lack of knowledge by members when they blame IT consulting companies for the situation.
A lot of scrutiny is now in place and consulate officers look at W2s and a lot of things are going on the background to make sure system is used in correct ways.
So if you think you can make a "scapegoat" out of consulting companies and blame them for retro etc.. that may not really help people.

Critics hope to make any increase in H-1B visas contingent on imposing new restrictions on companies hiring foreign-born professionals, scientists and engineers. While many of the critics’ attacks have centered on so-called “outsourcing” companies, the intent is to impose new restrictions on all companies that seek access to skilled foreign-born talent. As discussed later in this analysis, many of the restrictions put forward by Senators Richard Durbin (D-IL), Charles Grassley (R-IA), Bernard Sanders (I-VT) and Claire McCaskill (D-MO) would impact all U.S. companies hiring foreign-born talent.
Senator Grassley has said there is a "high amount of fraud and abuse" involving H-1B visas. However, an examination of objective data belies this statement. When questioned by the Wall Street Journal a Grassley spokeswoman cited only anecdotal evidence, saying, “People have called our office.” By objective measurements there is not evidence of significant abuse but modest problems that are addressed through agency enforcement.
The data show it would be mistake to tar all companies with the faults of literally a few. Of the $4.8 million owed in back wages in 2004, more than half (53 percent) came from findings against just 7 companies, none of whom are household names. Abuse does occur but the evidence indicates it is limited and of a character that can be handled within existing laws and regulations.
In fact, the amount of back wages owed to H-1B workers, small as it is, actually fell between FY 2005 and FY 2006. Moreover, the aggregate total of back wages owed is almost infinitesimal placed in the context of a $13 trillion economy. In FY 2005, only $5.2 million in back wages were owed to H-1B professionals based on DOL investigations and the total dropped to $4.6 million in FY 2006. Consistent with other years, 86 percent of the cases investigated (104 of 121) in FY 2005 resulted in no civil monetary penalties being assessed. In FY 2006, no civil monetary penalties were assessed in 89 percent of the cases completed (14 of 133).
The data show the vast majority of cases investigated by the Department of Labor have involved only paperwork violations, not willful abuse, and that back wage payments were generally fairly small. The proportion of H-1B professionals owed back wages is also small. Back wages were owed to less than 1 percent (0.28 percent) of the individuals who received H-1B status between FY 1999 and FY 2002 – a total of 1,323 individuals out of approximately 473,000 individuals.

Twice talked to IO :- First time response.. we are working on your case..
second response :- As per our info on my screen, it is not yet assigned to IO and neither pre-adjudicated. One person says one thing and another says another thing. I do not know what screen they are looking and how they are pulling info. What is the point of puting CSR if they have half baked info or worse no info on where the case is.
Have infopass appt late next week. Guess another garbage collecton day..:-)

ICICI Bank are suckers. They charged me Rs. 900 with fault on their side.
They raised the minimum balance from Rs 10K to Rs 15,000 from April 1, 2008 onwards. They didnt notified me in email and letter. But they charged 900 to me , stating I didnt maintained the required balance.
I fought with them that I will take ICICI to court of law and sue atleast 10,000 US dollars if they dont credit the money. The next day, they credited Rs.900 .
I decided not to make any more transactions with this CRAP bank. They will very less dollar conversion rate.

Was your previous approval based on an extension ? [Pending LC/Approved I-140 etc] ?
Yes. It was pending LC and they approved my I-140 last week. The status update happened immediately after my I-140 approval.Does your current transfer require documents from the previous employer ? [LC/Approved I-140] ? Yes. It was LC that was pending with my previous employer. Were you paid the prevailing wages mentioned in the LCA of previous H1B ?
Yes. I was getting paid little more.
Can this be supported by the W2 of last financial year [Not the paycheck].
Yes.
Did you have I-94 attached in the previously approved H1B ?
Yes.
Please answer these questions it might be helpful in finding what might have raised the red flag.

First they will process the applications which are cleared FP based on PD and receipt date. Always risk is there when filing without marriage. You are safe till USCIS starts process your application. When they take your application for processing then you cannot add your spouse. Also if CIR decides to process backlogs faster then also you will be in problem. Best option is if your marriage is already fixed do it within 3 months and file GC before PD is backdated. You need not file July first. You can wait till Jul15 to see next VB and decide.

Hello I got a yellow form 221(g) during my interview. Got my passport and approval back during the interview.
Are other people in PIMS getting this yellow form/ 221(g) stating that "when administrative processing is completed in your case we will contact you"?
This will allow me to decide if I am stuck in PIMS or something else.

I just got an email from the Chennai consulate, 29th day from the interview, stating the visa was stamped today:

should be receiving your passport/visa soon.

Telephone: 91 44 2857 4242
Fax: 91 44 2811 2027

whats up with USCIS issing RFE's and stuff for people with PD's so far away..Iam not sure what the RFE is but it makes me wonder what USCIS is doing with files with a PD of 04 that too eb3..:rolleyes:
So far what I have seen from various forums, looks like its a standard RFE for most of the cases.
Asking for updated G-325A(Its an updated form little different than what we submitted during july 2007) and EVL.
Just submitted my evidences today to USCIS to the RFE I received on March 19th. Hopefully it may mean that all other evidences are fine...like BC, MC and Medicals....

Anybody who has had a parent with diabetes and taken insurance? If there were any problems, did the insurance pay the costs? If possible can you also mention what problems came up during the stay.
