I think it all boils down to how desparate we are for GCs, many people here on H1 just want to count their valid H1 visa and multiply them by thier montly savings,
but Irish and many illegals itz a do or die situation they are smart people to knock on law makers door, before law-enforcing people knock on thier doors
If they werent desperate, they wouldnt be depressed due to BECs. The whole point of being depressed is because the validity of H1 is only as long as the job is valid. If economic recession hits and there are massive layoffs, even if you are in your first year H1 with 5 years remaining, you would be out of status on your way to becoming genuine illegal. And if you are in 7+ year of H1, then ofcourse you are walking on thin ice.
Trust me, there is desperation out there.
The problem is... The legals think way too much and analyze too much. The illegals get 5 minute guidance from someone on how to talk to lawmakers and they just do it without delving into the "Enemy of the state" kind of movie fantasies.

Just did a rough sketch on paper, and then drew it up in vector, no secret really... and to be honest it isnt perfect at all, but turned out ok.
I guess drawing it at a larger scale then shrinking helped with some of the fine tuning.

Though your case is weak(in my personal opinion because you seem to have entered US uninvited), A complaint against the employer may unravel some strong cases when the investigation happens.
This is from my experience:
Few years ago, some one complained against our employer about back wages and we all benefited from it. Our employer had to pay the wages for the vacations that we took (supposedly paid vacation) which they would not have paid, if the investigation had not occurred.

More likely cause is that the letter from the applicant notifying his new job never reached/registered in CIS systems.
Did the person send the letter in time? Was there any intermediate change in status between NOID and actual denial status? This is crucial to know before jumping to conclusions.
It was received well within time. If they don't receive resonse to request for evidence; they specifically mention it in the denial.
right now; there is issue with on-line case status with uscis. Not always updating. This is not what it is.

the question is, What happens to those july filers whose applications have not been returned yet and who will become current in the next bulletin.
Will USCIS ask them for the new fees.... Will they have to do all paperwork again including medicals.....what a mess!
It will be even interesting for cases that are not returned but will not be current in next bulletin. Your medical reports are valid for one year.

I am no expert on this but if labor substitution is eliminated it will remove anywhere from 30 to 50% of labor cleared from BEC. I know a lot of people who have applied for labor 2 to 3 times, they applied for a new labor every time they went to a new employer. It is these extra labor certifications that are being sold

If these numbers are correct then total EB-I pending applications are about 125K only. Thats less than one year of total quota and If USCIS work properly then this backlog can be cleared in one year (ignoring ROW for now). But thats not happening and backlog is increasing every year, especially for India.
Howcome, USCIS reports that pending I-485 is 620249 as Jan'2009.
Something is wrong. I wish we can get pending applications per year per category.

there are two factors here:
1. Regarding consultant coming to US. As employer told he does not have bonafide job offer. he is at 0% fault and consultant 100%.
2. Regarding paying for h1b fee. employer obviously did not make money here but he was not supposed to take money from consultant.
it's all about greed on both sides.
